หัวข้อ : แถลงการณ์ กรณีปราบปรามผู้ชุมนุมที่สงขลา ข้อความ : (คำแปล แถลงการณ์ กรณีปราบปรามผู้ชุมนุมที่ สงขลา) ฟอรั่มเอเชีย วันที่ 22 ธันวาคม 2002 นายกรัฐมนตรีไทยสนับสนุนการใช้กำลังตำรวจปราบปรามการชุมนุมอย่างโหดร้าย สภาเพื่อสิทธิมนุษยชนและการพัฒนาแห่งเอเชีย (ฟอรั่มเอเชีย) ขอประนามการใช้ความรุนแรงของตำรวจที่เข้าปราบปรามและจับกุมผู้ชุมนุมต่อต้านโครงการท่อก๊าซไทย-มาเลเซีย และรู้สึกตระหนกกับการที่สาธารณะชนให้การสนับสนุนการให้ความรุนแรงของตำรวจ นายสมชาย หอมลออ เลขาธิการฟอรั่มเอเชีย กล่าวว่า"ตำรวจและรัฐบาลไทยได้ละเมิดสิทธิมนุษยชนที่รับรองในรัฐธรรมนูญไทยและในกฎหมายระหว่างประเทศ ที่ให้ความคุ้มครองและปกป้องสิทธิการแสดงความคิดเห็นและสิทธิในการชุมนุมอย่างสงบ" ฟอรั่มเอเชียรู้สึกไม่พอใจต่อท่าทีของนายกรัฐมนตรีไทยต่อเหตุการณ์ความรุนแรงที่เกิดขึ้น นายกฯ อนุญาตให้ตำรวจใช้ความรุนแรงต่อทุกคนที่มีความคิดเห็นในทางตรงกันข้ามกับรัฐบาลแทนที่จะปกป้องสิทธิของประชาชน ฟอรั่มเอเชียเรียกร้องให้ปล่อยตัวผู้นำชุมชนและเจ้าหน้าที่องค์กรพัฒนาเอกชนทุกคนที่ถูกหมายตัวแล้วจับกุมในวันที่เกิดเหตุทันที ผู้ถูกคุมขังถูกทุบตีขณะถูกจับกุม และพบว่าได้รับการทรมานในขณะถูกคุมขัง ผู้ถูกคุมขังถูกปฏิเสธสิทธิในการพบทนายความและถูกปฏิเสธสิทธิในการขอประกันตัวและการเข้าเยี่ยม ทนายความจากสภาทนายความแห่งประเทศไทยถูกปฏิเสธที่จะให้เข้าพบกับผู้ถูกคุมขังเมื่อบ่ายวันนี้ (22 ธค) สภาทนายความฯได้รับการร้องเรียนจากญาติของผู้ถูกคุมขังและคาดหวังว่าจะได้สอบถามข้อเท็จจริงและให้คำปรึกษาทางกฎหมาย ต่อกรณีการรายงานข่าวของการใช้ความรุนแรงในการสลายการชุมนุมครั้งนี้ โดยในสถานีวิทยุทั่วประเทศ พบว่านายกรัฐมนตรีทักษิณ ชินวัตร ไม่เพียงแต่ไม่แสดงความเป็นห่วงใยต่อเหตุการณ์และไม่รับปากว่าจะมีการสอบสวนต่อกรณีดังกล่าวแล้วแต่กลับเตือนผู้ชุมนุมว่าหน่วยงานรักษาความปลอดภัยตัดสินใจทำงานได้อย่างเต็มที่ ถ้าผู้ชุมนุมไม่ยอมสลายตัว รัฐมนตรีและเจ้าหน้าที่รัฐที่แม้แต่จะมีหน้าที่โดยตรงต่อการต่อการเจรจาก็มีท่าทีลักษณะนี้ นายกรัฐมนตรีประกาศเลื่อนตำแหน่งในทันทีให้แก่เจ้าหน้าที่ที่มีส่วนในการปราบปรามการชุมนุมในครั้งนี้ ตำรวจทำการจู่โจ่มผู้ชุมนุมขณะที่มีการนั่งพักกินอาหารและการละหมาดทั้ง ๆ ที่เจ้าหน้าที่ให้ความมั่นใจในด้านความปลอดภัยแก่ผู้ชุมชุม มีตำรวจกว่าหนึ่งพันคนเข้าทำร้าย ผู้ชุมนุมและพยายามห้ามไม่ให้มีการเคลื่อนขบวนผู้ชุมนุมเข้าไปใกล้โรงแรมที่จะมีการประชุมรัฐมนตรีสัญจร ผู้หญิงบางคนถูกฉุดกระฉากเสื้อผ้าจนขาดวิ่น ถูกเอามือไพล่หลัง ชาวบ้านกลุ่มนี้ประท้วงการก่อสร้างท่อก๊าซในบริเวณพื้นที่ภาคใต้ของไทย ฟอรั่มเอเชียเรียกร้องให้สภาตำรวจแห่งชาติ พลเอกสันต์ ศรุตานนท์ รับผิดชอบต่อที่การออกคำสั่งให้ใช้ความรุนแรงในการปราบปรามผู้ชุมนุม ฟอรั่มเอเชียกลัวว่าการสอบสวนเหตุการณ์อย่างอิสระจะเป็นไปได้ยาก เนื่องจากรัฐบาลได้พยายามบิดเบือนข้อมูลข่าวสารเหตุการณ์ดังกล่าว รายละเอียดเพิ่มเติม ติดต่อ นายสมชาย หอมลออ เลขาธิการ ฟอรั่มเอเชีย 01-899-5478 For Immediate Release 22 December 2002 Thai Prime Minister Supports Police Brutality Against Demonstrators The Asian Forum for Human Rights and Development (FORUM-ASIA) condemns the use of violence by police who baton-charged demonstrators opposing the Thai-Malaysian gas pipeline project on Thursday, and is alarmed by the Thai Government's public endorsement of police brutality. Somchai Homlaor, secretary-general of the regional human rights organization, said the police and the Thai Government had violated the Thai constitution and basic international human rights standards which both protect freedom of expression and the right to peaceful demonstration. "FORUM-ASIA is disgusted by the Prime Minister's reaction to the incident - instead of protecting the people he has given the police free reign to use brutality against anyone who openly disagrees with the Government." Forum-Asia also called for the immediate release on bail of the community and NGO leaders who were singled-out and arrested during the crackdown. The detainees, who were beaten during the arrests, claim to have been further tortured in custody. The detainees have been refused their constitutional right to consult a lawyer, and have been refused bail and visitation rights. A lawyer from the Law Society of Thailand was refused access to the detainees this afternoon. The Law Society, responding to requests for help from the families of the detainees, hoped to interview the detainees with a view to providing legal assistance. Reacting to reports of the crackdown in a nation-wide radio address, Thai Prime Minister Thaksin Shinawatra, rather than expressing alarm or promising to investigate the incident, warned demonstrators that security forces would take the "utmost decisive action" if demonstrators did not disperse. This position is shared by most senior government ministers, including those in charge of "negotiating" with demonstrators. Prime Minister Thaksin immediately ordered the National Police Chief to promote police officers involved in the incident. Police attacked demonstrators as they sat down to eat and pray on Thursday evening, despite earlier assurances by the authorities that demonstrators would be allowed to present their demands in safety. About 1,000 police in riot gear beat demonstrators to prevent them from approaching the hotel where a cabinet meeting was to take place. Some of the women had their clothes torn off, and their hands tied behind their backs. The villagers were protesting the Government's controversial decision to build a gas pipeline in Southern Thailand. FORUM-ASIA called on National Police Chief General Sant Sarutanont to be held responsible for ordering the police to use violence to crackdown on demonstrators. FORUM-ASIA fears that an independent investigation into the allegations of police brutality will be difficult due to Government moves to stifle and manipulate news regarding the incident.
